न्याय मिलने में देर क्या अन्याय नहीं है ?

क्या
यही न्याय है ? अक्सर सोचती हूँ , आखिर इतना समय क्यों लगता है न्याय प्रक्रिया में ? न्याय कि गुहार करने वाला काल- कवलित हो जाता है , तो फिर न्याय क्या मरने वाले के प्रेत को मिलता है ? या फिर 20 साल में पूरी तरह बदल चुके अपराधी को ? न्याय प्रक्रिया के दौरान होने वाली मानसिक , सामाजिक एवं आर्थिक हानि के लिए जिम्मेदार कौन ?

Long Back in Dec 1999, a model Jessica Lall was murdered by Manu Sharma [son of senior Congress leader]. Manu was sentenced to life imprisonment in 2006. Justice delayed for seven years, where many eye witnesses were there?

Ruchika Girhotra, a fourteen years old girl was molested by Director general of police , Shambhu Pratap Singh Rathore [Haryana], in 1990. The disgraced official was sentenced for one and a half years of rigorous imprisonment . The punishment was for the molestation only. What about her death, the harassment and the humiliation that the family faced during the trial? The Justice was delayed by 20 years. Why?

Arushi, the teenager was brutally murdered and the killers are still free. More than two years now, when she will get justice?

Nirupama , a 23 year old journalist was forced to commit suicide. Who is the culprit and when she will get justice?

Let's talk about the victims of world's worst industrial disaster [Bhopal gas tragedy-1984]. How long they have to wait for justice? 25,000 died and over 5 lakh people faced the exposure of methyl isocyanate [MIC]. Warren Anderson is free and political figures involved in the release of Anderson are shamelessly silent over the issue.

Almost 26 years, but the justice is still far away.

Government of India can spend 50 crores on Ajmal Kasaab , the butcher, who brutally killed 173 innocent people and wounded 308, but do we have a metre long rope to hang him till death? Almost two years now since 26/11/08 the deadly terrorist is free and availing all facilities. The death sentence awarded to him by the trial court is in vain.

Why is the justice delayed?. Who is responsible? Why do we fear to punish the culprits?

I am 101% agreed with you

It also frustrates & upsets me that why this hugely slow process occurs in our judiciary system .
I am in favour of "on-the-spot" judgement system where minimum days of judgement should be 2 days & maximum days could be 1 week . Neither more nor less. Why cannot we have system like this .
And Divya Ji, there is also a very serious issue in all the cases which you have mentioned is that in all these cases, the earlier courts give judgements in favour of these culprits or gave them a very nominal punishment but after these cases are highlighted strongly in Media specially Electronic media & they raised a strong voice against unacceptable judgements given by the courts then whole system got alarmed and then hope of some justice occured .But bigger question is this that without the media is it not the duty of our judiciary system to give fair & unbiased judgements.

Those who are culprits & are involved in taking the life of innocent people should be hanged immediately whether it is manu sharma or kasab or afjal guru or anybody else .Infact I will say these should be given the punishment of death by the same method they killed the victims .Because these devils do not desrve an easy death penalty like hanging .These should also feel the pain through which the victim goes through because of their inhuman acts.

And what a joke it is that an terrorist today is the most secured & safe person in our country than our own countrymen.It is shameful.

I think we all should start a common blog in which we all should debate & passed an resolution or an act that what should be the right laws & how their concrete implementation should occured . I am not talking about to pass it in parliament, I am talking to pass it after we all will agree on different views & opinions given by bloggers on a common blog which we should start because when we will raise voices against this wrong system then those who are in favour of this system will ask us that -" do you have better system than this, if yes then present it ". At that point of time , we must have that better system & i am 100% sure that we can develope that better system through healty debates by opening a common blog for that. What you people & Divya ji says about it ?, I mean how is this idea of mine to have a debate for the search of better system by opening a common blog at which we all will be the members & after reading so many opinions & views, decision will occured through voting and opinion or a view or a law having majority opinion will be considered best for our judiciary & in near future we will present this whole system in front of our countrymen. .
If you all are agree then please tell your "yes" or "no" on this blog. Because if it is "Yes" only then we will move forward .

Unfortunately the judicial system in India is based on Evidences and facts not conscience or morals, so it should be easier, once having the facts at hand, all it needs is argument and hearing and quicker pronouncement of Justice. A judicial system that cares only about evidences and facts shouldn’t worry about taming the souls of the plaintiff and the defendant with time rather give justice as quick as it can, this delay/denial of justice leads to increasing "Out of Court settlements" which are cheaper and quicker thereby leading to the loss of trust in our Judicial System.
all examples given by you for delayed justice and pending justice indicates towards our weak judicial system. Nice post.

Yes it frustrates and our blood boils at such delays and indifference of people , who can definitely do something.

Like the common people , why the judiciary system is so miserable? Whom do they fear? Why do they delay ?

At times they give unfair decisions , while on the other hand when they give the right decision as in Kasab's case, then our impotent lot will delay the justice even farther.

Had it been America in place of India, such criminals like kasab would have been hanged long ago and his poor soul must have incarnated by now.

Regarding common blog-
Yes it's a very welcome idea. People with common thinking will join hands, sooner or later.

You raised a very valid point of 'out of court settlement'. The selfish lot is not at all concerned with the agony of victims. Even after having all evidences , they delay the justice, probably in some vested interests of them.

दिव्या जी , बिलकुल सही कहा है आपने । न्याय में देरी से अन्याय होने का खतरा रहता है । इसके लिए हमारा सिस्टम ही जिम्मेदार है ।
लेकिन इंस्टेंट जस्टिस भी कम खतरों से नहीं भरा है । सभी आतंकवादियों द्वारा यही तो किया जा रहा है ।
एक न्यायपूर्ण व्यवस्था में सभी संभावनाओं का ध्यान रखना पड़ता है । लेकिन न्याय इंसानी छल साधनों से मुक्त हो पाए , तभी न्याय की उम्मीद की जा सकती है ।

Dearest ZEAL:

Before I start I would like to highlight something about the origin of the quoted line "Justice delayed is justice denied."

This line was written by William Ewart Gladstone (1809 - 1898). He was one of the greatest of English Politicians and also a former British Prime Minister.

An interesting blog which is indeed thought provoking and you have kept is very open to any and all participative discussion that there could be on it. Nice style!

I would begin by stating that out of the thousands of cases that come up and are tried within legit time-frames, you have chosen the exceptional ones and are citing them as the norm rather than an exception.

I agree, the judiciary process in India as such takes a long time even in criminal cases. If it be a civil dispute, only the next generation of the plaintiff will be able to see the end of the case. Zmiles.

Let us primarily, go case by case on the ones you have mentioned –

Jessica Lal – ‘Influential’ political clout and criminal-police-politician nexus was the root cause for the miscarriage of the justice at the Trial Court level. It was only after a huge public outcry, that the case was handled properly and justice meted out.

Ruchika Gehrotra – Rakshak bane bhakshak. When those whom we had entrusted the responsibility to ensure law and order violate them, they are most sure to know how to make their way out of the mess. A very high-ranking ‘Influential’ police officer is at the centre of it. It was only a die-hard school mate of the victim who despite being in Australia, took the charge of things and brought some justice, though much, much delayed.

Arushi – When the ‘Influential’ complainants themselves want to bury the case, the culprits are sure to have a field day. Irony of the case is, no one is sure who the complainant and who the culprit is. Zmiles. Probably they are one and the same.

Nirupama – and there were other female journalists / poetesses earlier also who got cosy with ‘Influential’ politicians / people had to pay dearly for their association with them when they sought more than what was their due according to those men.

Bhopal Gas Tragedy – You keep saying that our nation must progress and become better. Will you believe it, dearest ZEAL, that Anderson reportedly was allowed to escape from India since the country heads, in that dire moment of human calamity, had merrily assembled in a hallowed chamber and collectively conclude that if an ‘Influential’ foreign national will be detained, it will aversely impact our nation’s progress? Facts of life!!

In each of the case you have mentioned, dearest ZEAL, the critical and common thread is the status of the accused – He is very INFLUENTIAL.

The undue exercise of influence essentially translates into corruption.

This is one of the biggest vices faced by our nation today.

According to Transparency International survey of 209, the CPI [Corruption Perception Index] of India is placing itself at the 84th Rank where the 1st rank denotes the best. Not something to be proud of as an Indian. [On a lighter note, Thailand also is ranked 84 along with Guatemala, Panama, El Salvaor. Zmiles]

Just digressing a bit, I will include and talk of your concerns of the previous blog too. There is always a relatively adequate money set aside in the budgetary allocation for the betterment of the down-trodden and for providing the basic amenities like hygiene and health-care to them.

But, what happens in reality? The major chunk of the granted money is siphoned off by the canny ministers and intermediaries and only a tell-tale set-up is done which will be inaugurated with much fan-fare and public media coverage to mislead the masses into believing that progress work is indeed happening in India.

Billions of dollars come in as grant / aid from the UN or the WB or the ADB which primarily has the noble idea of bettering the lives of the very poor. The system ensures that there is indeed ‘bettering’ but not of the poor and needy at all, rather, that is of the entire chain of people who will be having the money routed through.

We must accept we are a damn corrupt nation and that is a system-wide corrosion which can never be abolished by you or me or any ‘intellectual’ by either blogging or by actions. It is merely a way of our existence. Rather, than looking inwards to clear this mess, the better way is to look outwards and understand why other nations are better than us.

An argument can be placed here that there are 83 ranks above us, but 96 below us on a list of 180 and so we are better off than others. But, when we are aspiring for the best, will it serve any purpose to compare ourselves with those who are even worse than us?

We have a Gujarati saying which says –

Nishaan chuk maaf, nahi maaf nichu nishaan.

Translated it reads –

Missing a high target is better, but aiming low is unpardonable.

Coming back to our current topic of Judicial Delay –

In a corruption-infested set-up, the ‘Influential’ will always be able to buy out their way from any mess. Only a handful of rare ‘unlucky’ ones of that category will face the music. And the nation will keep trumpeting that Law is same for all – the low and the ordinary & the high and the mighty.

These cases you mentioned are simply of the ‘niche’ of ‘’influential’ people who have either the money or power to buy-out any obstacle that comes in their way of securing ‘justice’ [as they see it].

Leaving aside the politicians, the big businessmen, the powerful journalists, the police, the learned lawyers, even the judges are in the clutches of corruption with many a recent cases of ‘unjustifiable disproportionate assets’ being filed against the dispensers of justice themselves.

Thus, while the corruption angle is as such not within our ambit to tackle, let us also take a look at other reasons which cause justice to be delayed.

Judicial delay is a much-debated topic. The impartial, timely and predictable judiciaries stimulate investment, efficiency and technological progress.

Just as the heart, by employing muscular force, pumps blood at the right degree of pressure to ensure constant flow of blood throughout the body, the judiciary, by quick and just enforcement of the contracts by employing legal force, is expected to maintain the right velocity and pressure of economic blood flow, of money and other economic assets, from the undeserving to the deserving, the inefficient to the efficient, the dishonest to the honest, the incapable to the capable, the haphazard to the meticulous entrepreneurs, businessmen and other wealth creators and distributors.

Just as an inefficient heart results in the ailment called hypotension or low blood pressure, an inefficient judiciary contributes to low level of economic vibrancy and growth.

Justice is very much like a consumer product and must therefore pass the test of confidence, reliability and dependability like any other product if it is to survive the market scrutiny. Unfortunately, like consumer products, we do not have multiple vendors to turn to in the event of one of the service provider being not good enough!

Credibility of the judiciary is at stake now due to mounting arrears of cases, delays in disposal and also high cost of obtaining justice. The denial of justice through delay is the biggest mockery of law. It does not amount to mere mockery, the delay in fact kills the entire fabric of justice delivery system of the country.

The following are some thoughts on the causation of the delays and on how to by-pass them and ensure the swift execution of justice:

The foremost is the hopelessly less number of judges vis-a-vis the number of cases pending in their honourable courts awaiting the elusive justice.

Combined with this is also the efficiency quotient of the judges and the vacations that they have. Apart from the academia, only the judiciary enjoys ‘vacations’. Zmiles.

Delay in service of summons to the opposite side should be curtailed by declaring the opposition as ex-parte in the event of failure to deliver the summons.

Adjournments which put any case on hold for long periods must also be regulated. Today, it is used more as a tactical tool to disrupt the process of justice rather than to facilitate it by using the time so granted in expediting the process by producing more conclusive evidence to the case.

Law is essentially the formal enactment of precedents. Whenever an uncommon event occurs, it leads to the setting up of a new benchmark, a new precedent which then goes on to become a law. But, then with enormous amendments to a law, over a period of time, makes it truly cumbersome and also very subjective to interpretation and inference. Thus, while the Law may be observed in letter, but it will be defeated in spirit.

Even after meting out justice [mostly in Civil cases] and awarding the decree, it is often very time consuming for the victor to really get the decree executed to take the justice to its conclusive point.

Such is the state of affairs we are consigned to.

The times are hard and Hope is our only ally. I am a born optimist and surely, there will be deliverance for our mighty nation from such a grim situation. Awareness is the key and I wish none of us get embroiled in a matter of court. For those unfortunate ones who are there, [and I am clearly excluding the ‘Influential’ – since they will easily buy out their way], I pray to God for quicker redemption.

It was thrilling and exciting to write here, dearest ZEAL and I sign off pondering –

न्यायिक या प्रशासनिक परिवर्तन तंत्र केन्द्रित होते हैं। सुधार तभी आएगा जब तंत्र बदलेगा
। आदर्श तो यही है कि हम बदलेंगे युग बदलेगा लेकिन यथार्थ इतना आसान नहीं है। भारत ऐतिहासिक भूलों की मार झेल रहा है । अंग्रेजों द्वारा बनाया गया 1935 का ऐक्ट चन्द परिवर्तनों के साथ 1947 का संविधान बना। दण्ड संहिता उन्नीसवीं सदी की अंग्रेजों द्वारा बनाई हुई है। एक औपनिवेशिक शासन तंत्र के नियम स्वतंत्र देश के लिए लाभकारी नहीं हो सकते। वास्तव में 1947 में बस सत्ता परिवर्तन भर हुआ, तंत्र वैसा ही रहा और आज भी कमोबेश वैसा ही है। गोरे की जगह काले प्रभु शासन कर रहे हैं।
अनर्थक और निरर्थक नियम क़ानून बने रहें तो सत्ता के वर्तमान खिलाड़ियों के स्वार्थ सधते हैं। वे क्यों चाहेंगे कि इनमें परिवर्तन हों? जब तक परिवर्तन नहीं होंगे न्याय, प्रशासन, स्वास्थ्य ....सभी व्यवस्थाएँ ऐसे ही रहेंगीं।
एक विचारक ने कहा है - भ्रष्ट जनता स्वच्छ सरकार नहीं दे सकती और जागरूक जनता भ्रष्ट सरकार को सह नहीं सकती। मुझे इस वाक्य में ही समस्या का डायग्नोसिस नज़र आता है। प्रश्न यह है कि क्रांतिकारी परिवर्तन कैसे हों?
इसके लिए पहले इतिहास की समझ व्यापक करनी होगी। अगर हो सके तो हंसराज रहबर की ये पुस्तकें पढ़ें - गान्धी बेनकाब, नेहरू बेनकाब, तिलक से आज तक और योद्धा संन्यासी विवेकानन्द - उल्टे क्रम में पढ़ें तो ठीक। सम्भवत: राजपाल एण्ड संस, दिल्ली से छपी हैं
ऑर्डर देकर मँगाई जा सकती हैं।
इनसे समझ विकसित होगी। बहुत बड़े फ्रॉड का भण्डाफोड़ होगा। लेकिन व्यावहारिक समाधान क्या हो ? कैसे हो ? यह समझ में शायद न आए। भारत भू की मेधा सोई हुई है। शायद प्रतीक्षा और गिलहरी की तरह शुभ कर्मों में लगे रहना ही अपने वश में है।

But.......... there is an uncertainity in my heart and mind, if you would want me to be on this platform. Zmiles.

It is so for a simple reason.

I find your 'dream' very nice but I am a 'realist' too and ergo, very sceptical about it ever coming true. We - you, me, or all others who may cast an 'Aye' to your motion - are not Vidhaayaks / Legislators or empowered to bring about any enactment. Let us know our place clearly at the start of the mission else we will easily lose sight of the goal.

Blogging - as I see it - is merely a coffee-table past-time of the 'electronically-abled' and is akin to the 'chaupaal-ghoshti' of the village folk.

I am not very sure it can bring about any change. But, I am surely ready to give it a try. Nothing to lose. I expect 'zreo' so even a 0.0000000000000001 % change will be impressive if it comes about due to this 'dream' you have brought to the table.

We are the very ordinary people , the very common jantaa. I am wishful of change and surely will like to be part of the movement but surely I will be the bigger sceptic among the believers in your 'dream'.

किताबें तिलक से आज तक,गान्धी बेनकाब, नेहरू बेनकाब यहाँ से भी मँगाई जा सकती हैं (भगतसिंह विचार मंच, एस-16,नवीन शाहदरा, दिल्ली-32) । कई फ्रॉड नंगे होंगे । लेकिन समझ में आना और बात है और हल दूसरी बात। सुना है कि फ्रांस की क्रांति में बुद्धिजीवी जन जनता के आगे उसके साथ हथियार उठाए लगे रहे। अब शायद सम्भव नहीं है ।

आप के ब्लॉग पर टिप्पणी करना एक प्रोजेक्ट है :( पहली टिप्पणी के बाद सन्देश आया content too large| दुबारा टाइप कर सेव करने के बाद टीपने पर फिर वही सन्देश आया। टुकड़ा कर के पहला भाग टीपा तो पाया कि पहले के दोनों और तीसरे तीनों छप चुके हैं लिहाजा बाद वालों को मिटाना पड़ा।

बहुत बहुत धन्यवाद। यदि आप न बताती तो मैं इस महत्वपूर्ण पोस्ट तक नहीं पहुँच पाता।
भारत में न्याय में देरी के अनेक कारण हैं। लेकिन मूल और सब से बड़ा कारण यह है कि यहाँ अदालतों की संख्या आवश्यकता की 12 प्रतिशत है। अब सौ अदालतों का काम 12 अदालतों पर हो तो न्याय ऐसे ही होगा।
किसी भी समाज में न्याय भोजन और आवास से पहले की आवश्यकता है। क्यों कि यदि भोजन कम व आवास सीमित हुए और न्यायपूर्ण बंटवारा न हुआ तो वह परिवार तथा समाज में अशांति पैदा करता है। लेकिन आजादी के बाद भारत की केंद्र और राज्य सरकारों ने इसे प्राथमिकता नहीं दी जिस का नतीजा यह है कि आज अदालतें कम हैं।
अपराधों के द्रुत अन्वेषण और अभियोजन के लिए इस काम को करने वाली पुलिस सामान्य से भिन्न होनी चाहिए। लेकिन उस की कोई व्यवस्था नहीं है। हर समय थाने सिपाहियों की कमी से जूझते रहते हैं। जो स्टाफ है वह राजनेताओं के उपयोग में लगा रहता है। नतीजा यह है कि आरोप पत्र देरी से न्यायालयों में दाखिल होते हैं और अन्वेषण बहुत सतही होता है। 90-95 प्रतिशत मुकदमों में पुलिस अपराध की अपनी कहानी गढ़ती है, उस के अनुसार गवाहों के बयान लिख आरोप पत्र में संलग्न कर देती है। अब जब अभियोजन ही फर्जी होगा तो अपराधी कैसे सजा पाएँगे।
इन विषयों पर जब तक जनता आंदोलित नहीं होती तब तक सरकारें कुछ नहीं करेंगी।

I'm happy divya to see a girl raise such kind of burning question. We all are looking for Answer. Yes, I agree politician plays a great role behind this...cheap brutal politics....& sluggish judicial system. some changes are necessary in Indian constitution and Indian panel code procedure.....atleast rearrest of the rare case should be treated for speedy decisions.

We all are also responsible for same becoz we have Chalta hai attitude .....nobody is ready to initiate the things and don't feel the pain of others unless he, himself become the part of such kind of mishap.

I will be very happy to have you on the board. You are the 1st one (after Divya ji) from the viewers of this blog who took interest in my offer for a common blog. So I am thankful to you.

But I am not agree with some of your points which states that to bring change in the system or to work for the welfare of the people is not our duty & it is only the job of the Vidhayaks/Legislatures. I think it is our duty too as a citizen of this country to contribute in every effort which could make our country more prosperous. We cannot put this lame excuse that it is not our duty.

For Example- A man was moving on a road. Suddenly he got a jerk & fell on the road because his collission took place with a very big stone who was at the mid of the road .On this he think that how foolish are the people who put this stone in the middle of the road .And he went out by criticising them but do not make any attempt to put the stone aside .Similarly many people passed away from that road & they also got hurt by the stone but no one try to put the stone aside .On this a child take a step & tried to remove the stone by his own .But as stone was very heavy he was just able to shake that a bit but was not able to remove him from the middle of the road .But after watching child's attempts many people come forward & put their combined effort & remove the stone from the middle of the road .

Same thing we have to do .We have to try .If it works then it is great but if not that too is perfectly fine because something is better than nothing.

sorry brother, here also we have different views because for me Blogging is not merely a coffee-table past-time, for me it is an stage through which we can share our thoughts & views on different issues with the world & can try to bring a change in the wrong mentality of persons.It is not now & will never be a past-time for me.

I have read your comments on this latest post of Divya ji & I am very impressed about your deep knowledge of various issues. I am a bit wondered too that while having so much knowledge why you do not write your own blog ? You have potential my friend.

I have no problem with this that you will be the bigger sceptic among the beleivers of this project of mine .What matters to me that people's joining & most importantly good person's joining in this project so that we can initiate something. When India was not independent & some of the people want independense then also many were sceptics that whether it can be done or not .But we prove to the world that "Yes We Can".

So with best wishes,I welcome you on the board. But I will start working on this project after 7th of July,2010. And it may also possible that before 8th of July,2010 ,I could not be able to answer your reply or many person's replies who also wants to join this project because I am very busy upto 7th. Thanks for your valuable comments. But somewhere I feel that you are discouraging the efforts of bloggers to bring some positive changes in our system. We human beings are superior over tetrapods because of our thinking ability. Many can think but a lesser percentage of intellectuals are into writing. So I appreciate this mode of revolution [By positive blogging] as well.

If we start thinking that nothing can be done by blogging , then do you think anything better can be done by quitting blogging and raising voice against the irregularities in our system?.

We can participate and contribute our bit in this pious move .

You are very right in stating this. But we have to quit looking for such consolations. Instead we need to rise and raise voice against such activities happening around us.

In our sacred text “Bhagvad Gita” , It is said that…Saam, daam, Dand, Bhed….whatever way it is possible and suitable, one should rise and fight the battle.

Even Gods were with us in the battle of rightfulness and justice in Mahabharata.

A very valid point have been raised . Question is who will emphasize on the need of change in our judiciary. Is it not the duty of our people in respective spheres.

We need changes in our constitution and judicial system for speedy justice of disputes and issue [ trivial and bigger ones].

Our legislative assembly has the power to change and amend the existing laws. It can enact the statutory laws for the benefit of common people to get peaceful and timely justice.

I wonder where the members of legislative councils and assemblies are busy with?

I agree , lack of man power is one big reason behind the delay in justice. But why this shortage of working force in this field. In a densely populated country like India and a number of Law graduates, do we need to crib for man power ?

Apart from this, since you are a part of judicial system, is it not the duty of people associated with law, to raise voice for fair decisions, timely justice and enactment of laws for the benefit of common people and prosperity of our nation?

This is Ridiculuos. I still can't understand what is stopping Indian Govt from Hanging Ajmal Kasaab. Why did they waste soo much of money, time.. If something like this was going to happen, then he should have been died right there on 26/11. What a waste? Justice Delayed? If this is case than i am afraid there is no justice.

I think people will still do crime against India or IN INDIA because they NOW know that they will not be penalised(punished) for that.
Its time to make our own Govt, where there is no rules and regulations. Where We create our own rules and regulations, and punish the wrong and give justice to the Right Now and Then. What is the use of having High courts Supreme courts, when they can't provide justice ON TIME.
What is the use of having superior judges?
what is the use of having a strong police force?
What is the use of CID's, Intelligence and other Agenices?
What is the use of Evidence?
When you can't punish the criminals for their wrong deeds.
India can never be a Developed country, if this goes on..
It feels really bad, when the country has a wonderful resources we cant utilize it..

anonymous ji,...Your pain and anguish is quite evident in your comment. Glad to see sensitive people like you in our society.

But we cannot run away from the system. We cannot rebel like Naxalites are doing. They are worse than terrorists, killing their own innocent folk, just in demand of their rights for equality.

At times , I also feel like being aggressive and retaliate in the same fashion, but its not feasible. We must not waste our precious energy against such flukes.

Patience should be our hallmark in changing the system.

Like the evolution of earth, the process can be very slow, but the success is certain, I believe !

You are very right in stating that. It’s really disgusting to see a criminal getting VIP treatment in jail. Such is the pathetic system in our country. The people in power are indifferent towards the innocent victims and their families.

We have many Kasabs in the form of our politicians. They are into white collar crime and tagged as ‘Honorable minister’.

Not only government or politicians are not responsible for this pathetic situation. Common people are no less than criminals. They start feeling jealous with nice people , who put their efforts in the progress of nation.

They start pulling legs and start dragging them into controversies. Some people possess this filthy mentality.

We need to rise above this low mentality first and join hands with people with bigger and selfless goals. Then only a timely justice can be expected.

Problem is with our attitude which is a bit too eccentric. We rarely tend to bother outside our circle. And ironically people sitting at important position too are the same, may be worse.

We need to understand "With power comes responsibility" but actually who cares a penny after power.

दिव्‍या जी आया तो मैं पहले भी था इस पोस्‍ट को पढ़ने और पढ़कर चला गया। चूंकि इस विषय पर जगह जगह इतना विमर्श हो चुका है या हो रहा है कि लगता है नया कुछ कहने को नहीं है। बाकी मामलों पर मैं कुछ नहीं कहूंगा। पर हां भोपाल से ताल्‍लुक रखता हूं तो यह कहूंगा कि जो भी फैसला अभी आया है उससे किसी को आश्‍चर्य नहीं होना चाहिए। क्‍योंकि सब लोग जानते थे कि मुकदमा किन धाराओं में चल रहा था और उनमें कितनी सजा हो सकती है।
दूसरी बात कि इस त्रासदी के लिए जो भी लोग जिम्‍मेदार हैं उन्‍हें जरूर ही सजा मिलनी चाहिए। लेकिन इस त्रासदी के बाद भोपाल में इस त्रासदी के नाम पर जो और बड़ी बड़ी त्रासदियां हुईं हैं वे इससे कहीं ज्‍यादा पीड़ादायक हैं। उनके दोषियों को को कब सजा मिलेगी और कौन देगा। क्‍योंकि जिनसे यह अपेक्षा है वही तो इसकी जड़ में हैं।

I am surprised you found that somewhere I am discouraging the efforts of bloggers. Simply impossible.

Rest assured, I am too ordinary to influence anyone in the least. I know my aukaat, my capacity. I am not at BIG-SHOT. Zmiles. [And yes, neither I aspire to be one nor I will ever pretend to be one.]

I am very pragmatic in my outlook about what is feasible and what is not. Viability quotient of anything is the primary element to be considered before embracing a concept as a possible medium of change.

I am fully convinced that blogging is a brilliant past-time for anyone who loves teh written word and it stimulates a very healthy exchange of views. Nothing, I stress, nothing beyond that is the outcome of a blog. Extremely unlikely that any action in the real world can be emanating out of a blog.

To bring change, one has to do ground-work which is done by going out into the reality and working there in a very, very committed fashion. Sitting in the cosy confines of our homes and availing the conveniences of a laptop and [Google translator for Blog Headings], no change can be brought about. Let us be realistic about it. Blogging is merely an acknowledgement of the people who are electronically-able that we are aware of the problems that afflict our mighty nation and we do discuss them furiously.

Coming to the longevity of blogs. As such, the shelf-life of a particular post on a blog site is very ephemeral. Going by your own blog’s statistics, you posted an incredible 10 blogs in the month of June itself after it was ‘forcefully created’ on June 13th 2010.

Numerically, it says 10 blogs in 18 days!! Wow!!

Statistically, however, it translates to an average life of each blog of 1.8 days.

You yourself as a blogger are racing at break-neck speed bringing to the table one fine topic after another. With the advent of the new, the old topic is conveniently cast away into the annals of recorded oblivion. With the shelf-life being so fragile, will the future generation even know something was written here?

Curiosity of ‘what is the new post’ is a bigger component on blog than anything else. Therefore, at the maximum, after a week or 10 days, even if there be no new writing, the blog will by default peter off into oblivion.

You think change can be brought about in any way with such a short attention-span? For a week, it could give a reason to think deeply on. Later, the next blog [if not here, somewhere else], takes the attention.

Ponder on it.

Currently, we are discussing the judicial imbroglio. Soon, you will bring to all of us yet another wonderful piece of writing from your beautiful mind which will stimulate us to write and express our views. That too will pass by and yet another thoughtful post will be there.

Thus it shall go on. The discussion will always be very invigorating. The blog will always be pulsating. The tempo will always be racy. I know your huge potential. You are channelizing your energies in the best possible way given your circumstances.

I am awed by your splendid success and feel very proud of your achievements, dearest ZEAL! You surely are a fantastic writer and there is a passion in you to do something for the nation. I will always be with you in this noble endeavour. Reading your blog and comments is a revelation of your vision and I believe in your vision. आज जो भी हो रहा है सिर्फ इतिहास से सीख न लेने की वजह है , महाभारत में पांडवो को जुआ खेलना ही नहीं चाहिए था
कोई कितनी भी कोशिश करता कुछ बुरा हो ही नहीं पाता, पर शायद वो सब अगली पीढी को सिखाने के लिए प्रकृति का खेल हुआ हो ???
पर आज भी तो जुए की लत कितने घर मिटाती है .. हम सीख कहाँ लेते हैं .???.. हम बस देते हैं

A very valid point it is. The problem is indifference and insensitivity among people. It is not wise to blame government for every small and big error.

Today people have many vested interests. For them their own pain is too huge, how they can see others' pain?

Nowadays In the name of honor killings, Brothers and parents are involved. Then how can govt. be responsible for everything?

It is the uneducated lot, who believes in killing their own sisters [as kuldeep n Mandeep did], in the name of pseudo prestige.

Right education and proper guidance may rectify our mentality and correct the system.

Till then we have to contribute our best. Our smallest contribution will count and be a reason for a better and healthy system.

As it is said in our sacred text 'Bhagvad Gita'--"Do you duties , reward is not thy concern".

By raising my voice here against such issues, I am contributing my bit in hope to see a small change at least.

First of all as many said.. "Justice Delayed Is Justice Denied"..

And like some said, it is because of less number of courts..

But I would also point out:
Corrupt Lawyers - Delay valid cases. Favor 'known' criminals. 'Court ki taareekh badhanaa...' etc.
Corrupt Police - I do not have to say anything there.
Corrupt Politics - A lot comes from here.
Sleeping COMMON Man - Sab chalataa hai.... Theek hai... Mentality is one of the root causes.

One thing I love about USA is the fast and fair judicial system.

When killers of Indira Gandhi can be on trial for years, when Mr Kasab can be on trial for years.... Then what to say about criminals who committed crimes against COMMON Man??

As far as "Bhagwan ke ghar" is considered, it is separate domain, let's not mix it what HUMANs are responsible for.

WE ARE RESPONSIBLE FOR THIS!!

You very systematically kept your views. Unfair judiciary,corrupt cop and politicians are responsible up to a great extent.

Our 'let go' attitude adds to this delay. Until unless we become more sensitive to what is happening around us, we all will continue suffering like this.

The way we all raised voice in case of Jessica and Ruchica along with the help of media, a lot can be done. And such moves can become a lesson to people responsible for such delays.

Yes, You are right. Quite often we have witnessed that justice comes to next generation , when it becomes meaningless. The pains during trials takes it's toll.

My father is fighting his case for past 20 years. He is now retired . How long can he pay the fee of lawyers with the small amount of his pension he gets?

He has given hope. Desire to get justice has aborted in him.

ऎसा नही है कि किसी ने इस मुद्दे पर कभी बोला नही... ऎसा नही है कि इस मुद्दे पर बोलने से कुछ हो जाता... कान्विक्ट को सपोर्ट करते हुये न्यायिक व्यव्स्था मे कोर्ट मे तीन बार अपील की जा सकती है.. आपको नही लगता जिस देश मे हज़ारो लोग रोज़ फ़र्ज़ी केसो मे फ़साये जाते है उनके लिये ये तीन राउन्ड थोडी राहत तो देते है... लेकिन समस्या यह है कि न्यायिक प्रक्रिया बहुत धीमी है..

मुझे लगता है हमे एक सिस्टम बनाना चाहिये जो न तो पूरी तरीके से लोकतान्त्रिक हो और न ही तानाशाही लेकिन दोनो का मिला जुला रूप होना चाहिये.. तानाशाही की खामिया हम पहले ही देख चुके है.. और लोकतन्त्र की खामिया अपने वहा रोज़ ही दिख जाती है..

कभी कभी जब ये सवाल मुझे परेशान कर देते है मुझे लगता है हम इतने सारे सो काल्ड बौद्धिक इन्टेलेक्चुअल लोग समस्याओ की जगह सालूशन्स क्यू नही ला पाते.. कुछ ऎसे तरीके जिन्हे अपनाया जा सके.. इम्प्लीमेन्ट किया जा सके..

I agree with you, the three appeals are indeed a relief for innocent people trapped wrongly in any issue. This really brings justice to the innocents.

But my question is why the delay in cases like kasab?....for Jessica...for Bhopal tragedy?.....Here convicts are well known, not at all innocent, evidences against them are ample,then why the delay?

We do not have duties for our father, mother , spouse and kids only. We have a bigger family- Our society.

A very valid point raised by you. Evidences and witnesses are on sale since time immemorial. Lure for money allows a witness to deny or hide facts. A big reason behind the delays.

We need more witnesses alike Bina and Alpana , who dared to bring justice to Jessica and Ruchica respectively.

तो भाईजान ! क्या आप ये कहना चाहते हैं की अगर किसी मरीज़ को कोई गंभीर बीमारी है और डॉक्टर ठीक करने के लिए अपने परामर्श देते हैं तो वो परामर्श तभी सही होंगे जब डॉक्टर को भी वही गंभीर बीमारी हो या फिर हो चुकी हो , अगर ऐसा है तो अपना शोध जारी रखें क्योंकि आपका ये विचार पूरी दुनिया में एक अनोखी क्रान्ति ला सकता है

क्या आपको लगता है कि अंतर्राष्ट्रीय बिरादरी में,आतंकवाद के मुद्दे पर पाकिस्तान को ज़लील करने,उसकी थू थू करवाने के लिये कसाब पर खर्च की गई रकम सच में ज्यादा है ?


जी मुझे और इस दरिन्दे कसाब के कारण मारे गए उन सभी लोगों के परिवारजनों को तो एक आतंकवादी की सुरक्षा के लिए खर्च की गयी ये रकम बहुत ज्यादा लगती है , पाकिस्तान को ज़लील करवाने से वे मारे गए निर्दोष लोग वापस नहीं आयेंगे लेकिन इन दरिंदों को फांसी देने से मारे गए लोगों के परिवार्ज़ोनों के कलेजे को एक ठंडक ज़रूर नसीब होगी की चलो हमारे आत्मीयजनों का हत्यारा तो मारा गया , क्या ये हमारे सभी शहीदों,जवानों और देश के प्रत्येक नागरिक का अपमान नहीं है की आज वो हत्यारा हमारे देश का सबसे सुरक्षित व्यक्ति है , उसे तो पकड़ते ही उससे जानकारी हासिल करके सारे देश के सामने नहीं नहीं बल्कि सारी दुनिया के सामने गोली मारनी चाहिए थी ताकि इन आतंकवादियों और विश्व में एक कड़ा सन्देश जाए की भारत पे आँख उठाने वालों का ये अंजाम होगा .

अगर आपको मेरी किसी बात से बुरा लगा हो तो शमाँ चाहूंगा लेकिन उम्मीद है की एक भारतीय होने के नाते आपको बुरा नहीं लगेगा .

Even if the laws are hundreds of years old, then also at least the people in power are not so ancient.

Why the mentality also is as stale as the laws are? We need to change our mentality and thought process. Blame game should be over now. Enough of blame to politics, politicians and old stale laws.

Do we have the courage to accept the impotence in us?. Can we see our own filthy mentality? Can we accept the politics, indifference and selfishness in our attitude?

Until unless we reform ourselves, we should not expect the system to change suddenly.

Charity begins from home. We need to become selfless and a little more sensitive towards the injustice happening around us with our brothers, sisters and innocent children.

Daily we are hearing the news of Naxalite attack on railway tracks and passenger buses, killing thousands of innocent people and damaging our own property.

lot has been said above regarding our judiciary system. wat i feel,corruption is one more reason who is affecting back bone of judiciary sytem. i dont find any need to quote any specific case as every aware citizen of india knows about this problem.

Corruption indeed is one big reason behind all this . But the reason behind corruption is our polluted thinking, a sick and selfish mentality rather.

Because we do not punish the culprit timely they create havoc amongst innocent people. A similar incidence happened with me.

One kasab on parole came on my last post. He created terror on my post . All the readers were in panic. I was sitting helpless like our Judiciary. I tolerated him but the delay in Justice made him more aggressive. He imported few more kasabs. It was unpardonable!.

I decided to hang him till death. I took the right decision and timely hanged him . Such criminals should not be spared to create havoc anymore.

His soul is alive and smiling in his native place...

This kasab loves sweet comments on his posts but unfortunately he ends up doing ROITS on peace loving bloggers' post.

system needs to be evolved... there should be a deadline for every case ..like 40 days or something.

Nothing is impossible it can be done , but the people who have to pass the bill will never do, coz they themselves would be struck first by the law.

True what you said - Justice delayed is justice denied.. We should appreciate that many people have reacted and have given their views..Good, at least like minded people are speaking their minds, even through a blog.. I do agree that the main cause or effect of justice is negated as soon the delaying process begins, which is due to various reasons, as the others have stated, be it the no. of courts or judges, influence of the culprits, corruption, etc.
But the fact remains, JUSTICE IS DELAYED IN OUR COUNTRY AND WE ARE NOT DOING ANYTHING ABOUT IT..AND NOTHING CAN BE DONE TILL WE CHANGE OUR ATTITUDE TOWARDS THE JUDICIARY SYSTEM, TOWARDS OTHERS AND TOWARDS OUR LIFE.. TILL WE FEEL RESPONSIBLE.. TILL WE LOSE FEAR..
A few days back we had a "bandh" for rising prices. Most of us did not venture out of our houses.. WHY? Did we want to support it or for the fear our risking our vehicles, our lives.. Honestly, it's the latter.
Judgement has been passed on Qasab, but for what? He can be still be seen in the pages of newspapers, wherein, his routine behaviour in the jail is being transformed into a daily or weekly soap."He is lonely.. He is depressed.. so on.." We read it, the newspapers print it..
Similar, is the case with each and every incident you mentioned..
A thought just came into the mind :
Seene me aag liye phirte hain, par nigahon me hain narmi.. Pighlaa sakoo main hukumat ko, kahan se laun wo garmi..

You stated everything in just few lines. We really need to change our attitude first. Our attitude itself is not progressive, so how can we expect change in such a huge institution, judiciary and system.

you cited a good example of bandh, where people remained indoors , not to make it successful ,but to save their property n lives. We are constantly living in fear. We are in fact scared of our saviors.

but am glad to know, many are here with positive thinking and attitude as well.

सच तो यह है कि देरी से न केवल उसके प्रति अन्याय होता है जिसके प्रति अपराध हुआ, बल्कि उसके प्रति भी अन्याय होता है जो आरोपी होता है - क्योंकि समय से दण्ड न पाकर, संशय में जीना पड़ता है उसे -कई बार अपने किए अपराध से अधिक अवधि तक क़ैद में काटनी पड़ जाती है।
सबसे बड़ा अन्याय होता है आम जनता के प्रति - जिसने न अपराध किया, न सीधे अपराध से आहत हुई, मगर अपराध का दण्ड मिलने में होने वाली देरी से अपराध करने वालों के बढ़े हौसलों की ज़द में आ गई। सो विलम्बित न्याय से तो भयमुक्त समाज का निर्माण संभव नहीं।

लोकतंत्र में नागरिक राजा होता है , अब अगर राजा की अपनी जिम्मेदारियां भूल जाए , या अधिकार ( वो भी बेवजह के ) याद रखे तो कुछ ऐसा ही प्रतिबिम्ब बनता है अब हम आईने ( जैसे यहाँ पर कानून ) को दोष देते रहे की आइना गन्दा है तो ये तो हमारी समझ पर ही एक प्रश्नचिन्ह होगा , क्योंकि प्रतिबिम्ब तो हमारा ( समाज ) का ही है ना ??
हम सब बस टुकड़ों में स्वतंत्रता चाहते हैं स्त्री की अलग, पुरुष की अलग , धर्म की अलग , जाति की अलग .. और कभी कभी ये भी हमारे और कानून के बीच दीवार सी बन जाती है
